Data protection information according to Art. 13 Basic Data Protection Ordinance (DSGVO)

1. Responsible:

Profine GmbH, International Profile Group, Mülheimer Straße 26, D-53840 Troisdorf, info@profine-group.com, is responsible for data collection and processing.

2. Purposes, scope and legal basis of data processing

2.1 Execution and handling of the competition

We process personal data necessary for the execution and handling of the competition (title, name and e-mail address). The legal basis for the processing is Art. 6 Para. 1 lit. b DSGVO.
In addition, we process personal data that you voluntarily provide to us (first name, company, street, house number, postal code, town and country) for communication purposes in connection with the conduct and handling of the competition. It is our legitimate interest to facilitate and accelerate communication during the execution and handling of the competition and to ensure that every winner receives his or her prize. The legal basis for the processing is Art. 6 para. 1 lit. f DSGVO. You may object to this processing at any time with effect for the future pursuant to Art. 21 DSGVO.

2.2 Assertion, exercise or defence of legal claims

In addition, we may process personal data (title, first name, surname, company, street, house number, zip code, city, country and e-mail address) for the purpose of and in the interest of asserting, exercising or defending legal claims relating to the transfer of image rights. The legal basis for the processing of your data is Art. 6 Para. 1 S. 1 lit f DSGVO. You can object to this processing at any time with effect for the future in accordance with Art. 21 DSGVO.

2.3 Fulfilment of legal obligations

Finally, we process personal data insofar as this is necessary for the fulfilment of a legal obligation. The legal basis for the processing of your data in these cases is Art. 6 Para. 1 S. 1 lit c DSGVO in conjunction with the respective legal norm which imposes such an obligation on us. These may, for example, be standards from the German Tax Code (AO) or the German Commercial Code (HGB) which oblige us to store data.

2.4 No use for advertising purposes

We expressly do not use your personal data, which we collect within the framework of participation in the competition, for the purpose of direct advertising, unless processing for these purposes is already legally permissible due to other circumstances outside of participation in the competition. This is the case, for example, if you have already given us separate permission to do so in the past or if processing is based on legitimate interests pursuant to Art. 6 Para. 1 lit. f DSGVO and you have not exercised your right to object.

3. Storage duration of the data

We process and store your personal data only as long as it is necessary to achieve the aforementioned purposes. If, after these purposes have been achieved, there is a legal obligation to retain data that prevents deletion, the data concerned will be transferred to archives and further processing will be restricted. Final deletion will only take place after expiry of the statutory retention period.

4. Voluntary provision of the data

The provision of your personal data is neither required by law nor by contract.
However, the provision of certain data (title, name and e-mail address) is necessary for the execution and handling of the competition in order to identify and notify the winners and to make the prizes available.
As a result of not providing your information, you may not be identified and notified as a winner and we may not be able to send you your winnings.

5. Recipient of the data

We transfer the information we collect through the participation form on our website to service providers who assist us in operating our websites and related processes. These service providers are carefully selected, audited by us and contractually bound according to Art. 28 DSGVO.
The website is operated by us together with a commissioned external provider. This provider is the agency Electronic Minds GmbH, Feldbergstr. 80, D-64293 Darmstadt.

6. Your rights

According to the DSGVO you are entitled to the following rights:

6.1 Right to information (Art. 15 DSGVO):

You have the right to request confirmation as to whether personal data relating to you are being processed; if this is the case, you have the right to access this personal data and the information specified in Art. 15 DSGVO.

6.2 Right to rectification and cancellation (Art. 16 and 17 DSGVO):

You have the right to demand the immediate correction of incorrect personal data concerning you and, if necessary, the completion of incomplete personal data.
They also have the right to demand that personal data relating to them be deleted immediately if one of the reasons specified in Art. 17 DSGVO applies, e.g. if the data is no longer required for the purposes pursued.

6.3 Right to limitation of processing (Art. 18 DSGVO):

You have the right to demand the restriction of the processing if one of the conditions listed in Art. 18 DSGVO is met, e.g. if you have lodged an objection against the processing for the duration of any examination.

6.4 Right to data transferability (Art. 20 DSGVO):

In certain cases, which are listed in detail in Art. 20 DSGVO, you have the right to receive the personal data concerning you in a structured, common and machine-readable format or to request the transfer of this data to a third party.

6.5 Right of objection (Art. 21 DSGVO):

If data is processed on the basis of Art. 6 para. 1 sentence 1 lit. f (data processing to safeguard legitimate interests), you have the right to object to the processing at any time for reasons arising from your particular situation. We will then no longer process the personal data unless there are verifiable compelling grounds for processing worthy of protection which outweigh the interests, rights and freedoms of the person concerned, or the processing serves to assert, exercise or defend legal claims.

6.6 Right of appeal to a supervisory authority (Art. 77 DSGVO)

According to Art. 77 DSGVO, you have the right to lodge a complaint with a supervisory authority if you are of the opinion that the processing of the data concerning you violates data protection provisions. 
The right of appeal can be asserted in particular with a supervisory authority in the member state of your residence, your place of work or the place of the presumed infringement.
